An Elk Mound man is accused of battery to an elderly man after an altercation at the Rice Lake Speedway.

Levi J. Erickson, 21, was charged on Sept. 8 in Barron County Circuit Court with a felony count of battery to an elder person — intentionally cause bodily harm, a Class H felony that carries a maximum penalty of a $10,000 fine and six years in prison upon conviction. He also was charged with two misdemeanors: disorderly conduct and resisting an officer.

The defendant is free on a $2,000 signature bond. He must have no contact with the alleged victim, and must not possess or consume alcoholic beverages or enter premises where alcohol is sold. His adjourned initial appearance is set for Oct. 21.

According to the criminal complaint, a Barron County deputy responded at approximately 11:57 p.m. on Sept. 5 to the Rice Lake Speedway after a 911 caller said an intoxicated person had pushed someone down a flight of stairs.

When the deputy arrived, he saw two Speedway officials holding down Erickson. One official said the defendant was violent and drunk.

The defendant resisted the officer’s attempts to place him in handcuffs and yelled obscenities. He also elbowed the officer in the chest, dislodging his body camera. The deputy reported that Erickson’s eyes were bloodshot and glassy, and his breath smelled of intoxicants.

A witness provided a video of the altercation. A man identified as Kaedyn Peterson was seen telling an agitated Erickson to sit down, but the defendant tried to push past him.

Four older men, including a 78-year-old identified as C.R.B., were standing a few rows behind the defendant and Peterson. Erickson swung at one of the men identified as J.W. and pushed him.

The four men walked down the stands toward the exit, and the defendant pushed past Peterson and chased after them.

Erickson attacked one of the other men, but lost his balance. Then he stood up and punched C.R.B., who was not involved in the fight, in the face.

C.R.B. was transported to Marshfield Medical Center for evaluation and treatment of his injuries.
