ANGOLA — The argument was over before deputies arrived, but actions taken during the fight led to a felony weapons charge.

Michael P. Albert, 68, of the 2200 block of South C.R. 150W, was arrested Sunday at his residence where he was charged with Level 6 felony pointing a firearm and Class A misdemeanor domestic battery.

The probable cause affidavit filed in Steuben Superior Court states that at 9:25 a.m. Sunday deputies responded to a domestic dispute in the 2200 block of South C.R. 150W where three witnesses reported Albert had a gun.

Deputies found him cleaning eggs over the kitchen sink while his Winchester 70-270 rifle was propped up against the living room wall with a round in the chamber and the safety off, according to court documents.

His only statement was “She hit me first.”

Each of the other three said Albert started yelling at one of the residents so they went outside, but he followed and kept yelling so they ran back in and barred the door.

When Albert pushed his way in, one of the females slapped his arm and he punched her in the head, causing injury to her right ear, according to court documents.

When a male resident intervened, Albert reportedly grabbed his gun. They wrestled for control while a third resident called 911 and took cell phone photos, but he calmed down after all three went back outside to wait for police.

If convicted, Albert faces a maximum three-and-a-half prison sentence with a possible $10,000 fine.
