READING, Pa. - A preliminary hearing was held Monday afternoon for a 16-year-old charged in the deadly shooting of another teen last month.

According to the police, 16-year-old Daniel Cruz Jr shot Felipe Rodriguez Jr. outside a Fourth of July gathering in the 1100 block of Windsor Street just before midnight.

Multiple eyewitnesses, including Cruz's father, testified, with his father saying he told his son to go get his gun after a dispute over trash in the street outside the party.

Additionally, a key eyewitness included a neighbor who said he saw Daniel Cruz Senior being jumped by his car and that his son yelled: "Stop jumping my dad."

The defense for Cruz Jr moved to have the charges changed to self-defense in the case, arguing that what happened does not constitute first-degree murder.

Meanwhile, the prosecutors argued this is a tragedy but also a crime. They say they believe they've met their burden.

An arraignment hearing is slated for October 1st at 9 a.m.

The defense for the teen told 69 News she plans to file a decertification request to have the case moved to juvenile court.
